for Understanding Children Better courses

1. Applicability, Course Participant Information

The terms and conditions below and only these terms apply to all Understanding Children Better courses provided by Karen Netzel – Parent & Family Coaching to any individual or organization. In these terms (“the Terms”), “I”/“me” means Karen Netzel, and “you”/“your”/“yours” means you, the course participant. 

No variation to these Terms shall be binding unless agreed in writing and signed by both parties.

On booking a course, you accept these Terms.

2. Definitions

“Fee” means the sum payable by you to me for Courses. 

“Course” means Understanding Children Better – Toddlers & Preschoolers or Understanding Children Better – School Children course as booked by you. 

3. Karen Netzel’s Status 

I am engaged as an independent business owner. Nothing herein will be deemed or construed to create an employer-employee, joint venture, partnership, or agency relationship between me and you for any purpose whatsoever. 

4. Participant Status 

By booking a Course with me, you warrant that: (i) you are legally capable of entering into binding contracts; and (ii) you are at least 18 years old. 

You understand that any results from your participation in the Course are dependent on your actions. You participate in the Course with the full understanding that you are wholly responsible for creating your own results. 

You understand and agree that the Course provided by me is in no way to be construed as psychological counselling or therapy.

It is your responsibility to seek appropriate therapy, as needed.

5. Booking a Course

Courses can be booked online at https://karennetzel.com.

You will receive an e-mail confirmation of your booking. Should the Course be fully booked, I will inform you as soon as possible. 

A Course takes place when there is a minimum of 4 participants. There is a maximum number of 10 participants per Course. 

In legal terms, booking a Course represents a service agreement under § 611 of the German Civil Code (BGB). When you book a Course via my website (e-mail or telephone) you are requesting me to provide you with the Course services and entering into a Course agreement as defined by these Terms. 

I agree to provide the Course to you and you agree to pay the Fee for the same subject to these Terms.

The amount of the Fee is in accordance with the Fees stated on https://karennetzel.com. By booking a Course, you agree to pay the Fee in full at booking or as stated in the confirmation e-mail.

There is no general admission to the Course and the I reserve the right to decline a Course booking in individual cases. This shall only ever be in line with my legal and ethical obligation and desire not to discriminate against any person and in accordance with anti-discrimination law. In this case, you will be informed immediately in writing and any Fee paid reimbursed in full.

By booking a Course, you commit to participating in the entire course. I do not refund any Fees if you do not attend on individual Course dates.

The Course takes place in Heidelberg, Germany at the address provided my me.

6. Limitations

Participation in the Course is not therapy and cannot take the place of psychological counselling or therapy or personal participation in comprehensive psychological therapy.

It is your responsibility to seek appropriate therapy, as needed.

7. Cancellation Policy

You have the right to cancel your Course in accordance with § 3 of the Distance Selling Act booking before the Course begins. You can cancel your Course booking within 2 weeks without giving a reason.

In the event that you cancel your Course booking after the Course has begun, you are required to pay the Course Fee in full.

8. Limitation of Liability

I shall not be liable to you for any results from your participation in the Course, nor for any negative consequences, damages and losses (including without limitation, any direct, indirect, punitive or consequential loss or damages, and whether in tort (including without limitation negligence, contract or otherwise)) that may result in connection with the Course, as far as there is no intentional or grossly negligent behaviour on my part.

My liability to you shall at all times be limited to the amount paid, if any, by you for the Course.

Where reference is made to third party offers, e.g. via links, no liability is assumed for the contents of these providers. Unless I expressly declare otherwise, by linking to third party offers, I do not endorse opinions or factual claims published or represented by third party offers or claim these as my own.

9. Confidentiality

In Course meetings, there is a policy of confidentiality for all participants. In accordance with § 203 of the German Penal Code (StGB) as well as for ethical reasons, I am bound to a duty of confidentiality (disclosure of private secrets).

I acknowledge that anything you share with me is completely confidential. 

I undertake not to disclose any information you share with me in any session in any way whatsoever (unless in the unlikely event that I am required to do so by law).

10. Data Recording

Within the scope of the Course, your personal data is stored to enable me to provide the Course in the best way possible. 

By booking a Course and agreeing to these conditions, you consent to your data being stored.

11. Fees & Payment

The Course Fee is payable in Euros by PayPal or bank transfer at the latest 5 days (working days) before your scheduled Course begins. 

The Course Fee includes my services as course facilitator as well as organizational and administrative costs and includes 8 course meetings à 90 Minutes each:

  • 129.00 Euros per participant
    Pay in full or in instalments; Discounted Fees for single parents and co-parents attending together on request. 

Deviations from the Fees stated and any additional agreements must be made in writing and agreed by both parties.

Fees are exempt from VAT in accordance with the German small business regulation (pursuant to §19 No.1 of the German Turnover Tax Act (UstG.)).

Since I am a private practice, Fees cannot generally be billed to a public institution and cannot usually be covered by health insurance. You will need to cover the cost of the Course privately.

If you do not attend the Course without cancelling (as outlined in 7.  Cancellation Policy), you are required to pay the Course Fee in full. Any outstanding Fee will be claimed by invoice.

You understand and agree that, in the event of no or delayed payment, I reserve the right to: (i) charge interest on any late payment; (ii) claim compensation for any reasonable debt recovery costs incurred by me from you should any action be undertaken to obtain settlement of the account. 

12. My Obligations and Refunds Policy 

I shall endeavour to provide the Course in accordance with these Terms. 

In the event that I cancel a Course, for any reason, I shall offer you a new date for the Course and no additional Fee shall be payable by you. In the event that it is not possible to offer you a new date, I will reimburse the Fee in full. 

I reserve the right to cancel a Course due to lack of participants or for other reasons for which I am not responsible (e.g. sudden illness, force majeure) up to 5 days before the Course start date. 

If a Course has to be cancelled, the Fee paid will be reimbursed immediately.

Further liability and compensation claims are excluded.

13. Your Obligations and Cancellation Fee

You have the right to cancel your Course booking before the Course begins or you may name another person to take your place. 

If you cancel your Course booking up to 5 days (working days) before the scheduled date, no further charges will be incurred. The Fee paid will be refunded.

If you cancel at short notice, a cancellation Fee is due as follows: 

Cancellation within 4 days (working days) of the scheduled start date:

  • Half of the agreed Fee must be paid. 

Cancellation within 2 days (working days) of the scheduled start date or within 24 hours:

  • The agreed Fee must be paid in full. 

Cancellations can only be accepted until 5 pm. If a cancellation is made after 5 pm on a working day, it is deemed to have been made on the following day. 

Cancellations received at the weekend or on a public holiday (whether by e-mail or telephone) can only be accepted from the next working day.

You may name another person to take your place on the Course up to 2 days before the Course start date as long as he or she meets the Course requirements. 

The person you name to take your place must make a new Course booking in their name. No further charges will be incurred by you or the person who takes your place.

As stated above, there is no general admission to the Course and the I reserve the right to decline a Course booking in individual cases. 14. Changes to the Course

I reserve the right to make necessary changes to the content and organization of the Course before or during the course, provided that these do not significantly change the overall character of the Course.

I will inform all registered participants immediately of any necessary changes.

15. Notices 

All notices to be given under these Terms will be in writing (which may include e-mail). Any notice given by e-mail shall be deemed served when dispatched. 

16. Force majeure 

I shall not be liable to you or deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of our obligations in relation to Courses, if the delay or failure was due to any cause beyond my reasonable control.

17. Entire agreement 

These Terms, together with the booking confirmation, constitute the entire agreement between the parties and shall exclude any other agreement, or understanding of any kind, whether oral or written, relating to the Course.

18. Severability 

If any part of these Terms is found by a court of competent jurisdiction to be invalid, unlawful or unenforceable, then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

19. Governing law and jurisdiction

Any disputes shall be governed construed in accordance with local law by the local court of competent jurisdiction for the agreed business location.
